2015 Founders Celebration
After 17 August 2015, a new European Regulation will govern cross border successions and harmonize conflict-of-law rules without affecting the substantive inheritance laws of the EU Member States. Under this Regulation, one single criterion will determine the jurisdiction and the law applicable: the last habitual residence at the time of death, even if the country is not itself an EU Member State.
The EU Succession Regulation will also unify the rules of evidence since it creates a new uniform European Certificate of Succession to enable heirs and legatees to prove their rights in all EU Member States, requiring that European lawyers who deal with cross border successions have access to an extensive network of foreign lawyers acting as “local correspondents”. This major change will definitely reshape the practice of Estate planning in Europe.
